Though motions for summary judgment, default judgment and orders of reference had previously been spread out among 27 judges, the administrative judge for civil matters in Brooklyn Supreme Court decided to funnel the cases to three judges, a move advocates are concerned could bring more delays or compromise the quality of adjudication. As a legal services provider who has served almost 1,000 cases since the 2008 mortgage catastrophe, I can say that in all but a very few cases, the issue of delay is both the fault of the plaintiff as well as to the plaintiff’s benefit.
